Page title: Terms and Conditions · Shopify slug: terms-of-service

1. Scope

(1) These Terms and Conditions ("Terms") govern every agreement concluded via the online shop at orvian.com between the operator of orvian.com (hereinafter "ORVIAN", "we", "us") and the buyer (hereinafter "you", "Buyer"). Our range encompasses goods in the home and garden categories.

(2) A consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade or self-employed professional activity. A business buyer is any natural or legal person, or partnership with legal capacity, who acts in the exercise of their commercial or independent professional activity at the time the contract is formed.

(3) Any deviating, conflicting or supplementary conditions submitted by the Buyer shall only be incorporated into the agreement if their validity has been expressly acknowledged by us in writing.

2. Contracting Party and Contact

The contract of sale is concluded between you and the operator of ORVIAN. Full provider particulars are set out on our Legal Notice page.

3. Conclusion of Contract

(1) The display of our home and garden merchandise in the online shop does not constitute a legally binding offer; it serves solely as a non-binding online catalogue.

(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to acquire the goods contained in your shopping basket.

(3) Acknowledgement of receipt and acceptance of your order occur simultaneously — you will receive both immediately after placing your order by way of an automatically generated email. Upon despatch of that confirmation email, the contract of sale becomes legally binding.

(4) We retain the contract text and send it to you together with these Terms by email. The Terms currently in force are also accessible at any time at orvian.com/terms-of-service.

(5) Contracts are concluded in the English language.

4. Prices and Shipping Costs

(1) All prices shown on the website include the applicable statutory Value Added Tax. Any delivery charges are displayed separately during the checkout process.

(2) For shipments to destinations outside the European Union and the United Kingdom, customs duties, local taxes and further charges may apply; these fall solely to the Buyer.

(3) Full particulars of delivery charges and estimated shipping windows are available on our Shipping & Payment page.

5. Payment Terms

(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in specific cases.

(2) The full purchase price is due upon conclusion of the contract.

(3) Where payment is made by credit card or PayPal, your account will be charged immediately upon completion of the order.

6. Delivery

(1) Goods are sent to the delivery address supplied by the Buyer. The applicable delivery windows are shown on each product page and throughout the checkout process.

(2) Should delivery remain impossible after three attempts, we are entitled to withdraw from the contract. Any amounts already paid will be refunded without delay.

(3) In the event of delays attributable to force majeure, the delivery period shall be extended proportionately. We will inform you of any such situation as promptly as possible.

7. Retention of Title

All despatched goods remain our property until the full purchase price has been received.

8. Right of Cancellation for Consumers

Consumers are entitled to a statutory right of withdrawal. Full cancellation details and the model withdrawal form are available on our Cancellation Policy page.

9. Warranty and Liability for Defects

(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.

(2) For second-hand goods, this period is reduced to one year from delivery.

(3) Should any delivered item prove defective, please contact us at contact@orvian.com.

10. Liability

(1) We accept unlimited liability in cases of intent and gross negligence, and within the scope of applicable consumer protection legislation.

(2) In cases of ordinary negligence, our liability is confined to breaches of a fundamental contractual obligation — one whose fulfilment is essential to the proper execution of the contract and upon which the Buyer may reasonably rely. In such cases, liability is capped at foreseeable, contract-typical loss.

(3) Liability for injury to life, limb or health is unaffected by the foregoing.

11. Dispute Resolution

(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

12. Applicable Law and Jurisdiction

(1) The contractual relationship is governed exclusively by the laws of England and Wales, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection afforded by mandatory provisions of the consumer's country of habitual residence is not thereby removed.

(2) Where the Buyer is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this relationship.

13. Final Provisions

Should any provision of these Terms prove or become wholly or partially void, the validity of the remaining clauses shall not be affected. The relevant statutory rule shall substitute any invalid provision.
